Difference between CESTAT vs GSTAT

When disposing of any proceeding, the appellate tribunal is not bound by the procedures laid down under CPC. The Code of Civil Procedure has detailed guidelines regarding summoning witnesses, documents, etc. However, tribunals are not bound by the procedure laid down in the CPC.

Authorities have made CPC procedures ideally, tribunals should also abide by the CPC procedure, but they have their own regulated procedure. The best way to understand is current seat law and see the differences between CPC and C, how they function, and why CPC is not applicable to CA.

CPC is a general law for suits in India. When individuals fight over aspects of a contract, it becomes a civil procedure matter with detailed guidelines on producing evidence, summoning witnesses, etc. In contrast, CESTAT only deals with matters related to indirect taxes between the taxpayer and a government department. The initiation of proceedings under civil suits has detailed guidelines, while in CESTAT, written documents certified by the government are usually used.

In civil suits, initiation have detailed guidelines regarding filing complaints, service of summons, appearance, etc. In CESTAT, written documents like notifications and circulars are certified and available on the government portal. The burden of proof in civil suits always lies on the person who institutes the suit, while in CESTAT, the burden of proof lies on the taxpayer to prove incorrect tax imposition.

Civil court proceedings are adversarial, while CESTAT is more informal and does not involve conflicts of interest. The execution of orders in civil court requires a separate procedure, while in CESTAT, orders are executed without involving attachment of property.
