Registration of Births and Deaths (Amendment) Act, 2023

Ministry of Law and Justice has introduced the Registration of Births and Deaths (Amendment) Act, 2023.

Key highlights in the amendment include the substitution of sub-sections (2) and (3) of section 10 in the principal Act. Under the new provisions:

1. In cases where a death occurs in a medical institution providing specialized or general treatment, regardless of ownership, the institution must provide a certificate of the cause of death, along with the medical history if applicable. This certificate, signed by the attending medical practitioner, is to be submitted to the Registrar in the prescribed form. Additionally, a copy of the certificate should be given to the deceased person's nearest relative.

2. If a person passes away outside a medical institution and had been attended to by a medical practitioner during their recent illness, that medical practitioner must promptly issue a certificate of the cause of death, including any relevant medical history. This certificate, in the prescribed form, should be provided free of charge to the person responsible for reporting the death under this Act. The person receiving the certificate must present it to the Registrar when providing information about the death as required by the Act.

3. for individuals falling under categories of sub-section (1) of section 8 of the Act:

a) If such individuals fail to provide necessary information that they are obligated to give without reasonable cause.
b) If they intentionally provide false information for inclusion in the birth and death register, knowing it to be untrue.
c) If they refuse to provide their name, description, place of abode, or sign the register as required by section 11.

For any of these violations, a fine of up to one thousand rupees may be imposed for each birth or death event.

It is important to note that the amendment will take effect on a date appointed by the Central Government through a notification.
